1. ア 開示後に本契約に違反することなく公知になった情報は、本契約上の秘密情報に該当するが、第三者に開示しても秘密保持義務違反とならない。
2. イ 秘密情報の受領者が、本契約に基づく開示時点で受領者が既に保有していた情報であることを理由に秘密保持義務を免れるためには、そのことを第三者の証言で立証しなければならない。
3. ウ 文書に記載された情報が本契約上の秘密情報に該当するためには、秘密情報である旨の表示が必要である。
4. エ 本契約の条項を第三者に開示する際は、相手方当事者から事前に書面による承諾を得る必要がある。
